Bankruptcy Checklist
Filing Bankruptcy Checklist
Once you have retained your attorney and decided which Chapter to file, you will have three basic “homework” steps to complete before we can prepare your case for filing. You will (1) fill out a questionnaire, (2) gather documents, and (3) complete a credit counseling course online.
- The Questionnaire. We will go over this with you so that you understand exactly which sections apply to you, and how to interpret the questions. This questionnaire mainly covers your debts, assets, and income information over the last few years.
Download The Bankruptcy Questionnaire(Also, please see our blog post on Listing All Creditors in Your Bankruptcy Documents.)
- Documents Needed. To prepare your bankruptcy case, we need our questionnaire filled out, as well as copies of various documents. In order to verify the information we put in your petition and schedules, the trustee will request these same documents for his own review. We will give you a list and go over everything with you in detail so that you understand exactly what we need and where to find it.
(For more about this, see our blog posts on The Basics: The "Credit Counseling" Requirement and The Basics: You Can't Finish Your Bankruptcy without "Debtor Education.”)
- Credit Counseling. Everyone who files bankruptcy has to do this. We always send people to https://bothcourses.com/ to complete the credit counseling because they are one of the least expensive providers ($9.95 – you pay directly). You must do the first course within 6 months before filing your bankruptcy case.
When you have completed your homework and are ready to make your final payment, call us at (502) 964-7878 to schedule a time to come in and drop everything off. Once we have everything, it only takes a few days to get your bankruptcy case prepared and filed. Once your case is filed, you are protected under the bankruptcy code, meaning, no one can call you, sue you, repossess, garnish, or foreclose! We will go to Court about a month later.
(For more about your bankruptcy filing stopping creditors see our blog post Summary about the Automatic Stay and the dozen or so before then. For more about the hearing about a month after filing, see The Chapter 7 “Meeting of Creditors” and The Chapter 13 “Meeting of Creditors.”)
